Terms of Service

These Terms of Service ("Terms") govern access to and use of https://emailfiredomain.com and the Email Fire Domain service (the "Service") operated by FiveToClose ("we," "us," or "our"). Email Fire Domain is another product of the brand FiveToClose.cloud.
By accessing the site, creating an account, connecting mail credentials, starting a subscription, or using the dashboard, you agree to these Terms, our Privacy Policy, and Disclaimer. If you do not agree, do not use the Service.
1. Description of the Service
The Service is a subscription SaaS product intended to help operators warm sending domains in a hands-off manner after account setup and payment. Features may include:
- Google OAuth sign-in and mandatory TOTP two-factor authentication
- Per-domain subscription billing via Stripe
- Domain registration in the dashboard and ownership verification (e.g. DNS TXT token)
- SMTP and IMAP connection settings you supply for your mailbox/domain
- Automated warmup ramps and seed-style engagement cycles (send, spam-rescue tracking, open tracking, human-like replies)
- AI-assisted generation of short natural message text (with rules such as avoiding em-dash / robotic phrasing where implemented)
- Dashboard metrics, job status, and event history
The Service is provided "as is" and "as available." Features may evolve. We may change algorithms, ramp schedules, seed engagement methods (including simulated and/or real network components), AI models, or verification methods to improve operations or respond to provider changes.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You may not use the Service if you are barred under applicable law or if we have previously suspended your account.
3. Accounts and security
- Access requires Google sign-in. You must provide accurate information and maintain control of the Google account you use.
- You must complete authenticator (TOTP) 2FA setup and keep your device and backup codes secure.
- You are responsible for all activity under your account.
- Notify support@emailfiredomain.com immediately of any unauthorized use or suspected compromise.
- We may suspend or terminate accounts for security risk, fraud, abuse, or Terms violations.
4. Subscriptions, pricing, and billing
Unless otherwise stated at checkout, subscriptions are billed per sending domain:
- Monthly: USD $79 per domain per month
- Annual: USD $790 per domain per year (approximate monthly equivalent ~$65.83)
Prices are in United States dollars and may exclude applicable taxes. We may change prices for future periods; existing subscriptions renew at the rate you agreed unless we notify you as required by law or Stripe settings.
Billing is handled by Stripe. By subscribing you authorize recurring charges until you cancel. You may cancel via the Stripe customer portal or by emailing support@emailfiredomain.com before the next renewal. Cancellation generally takes effect at the end of the current paid period.
Fees are non-refundable once a billing period starts, including if you are dissatisfied with warmup results, metrics, or deliverability outcomes, except where required by law or where we expressly offer a refund in writing.
Failed payments may result in suspension of paid features until resolved.
5. Your mail credentials and domains
By connecting SMTP/IMAP or similar credentials you represent and warrant that:
- You own or are fully authorized to use each domain and mailbox you connect
- You have the right to grant us access to send and receive mail as needed to operate the Service
- Credentials you provide are accurate and will be kept updated
- You will use app passwords or least-privilege credentials where available
You authorize us to use those credentials solely to provide the Service (warmup sends, engagement loops, metrics, support debugging with your consent). You remain solely responsible for your mail servers, DNS (SPF/DKIM/DMARC), provider limits, and any blocks or suspensions imposed by Google, Microsoft, or other carriers.
6. Your responsibilities and compliance
You agree that you will:
- Use the Service only for lawful purposes
- Comply with CAN-SPAM, CASL, GDPR, CCPA/CPRA, and all other applicable marketing, privacy, and anti-spam laws
- Comply with your ESP, Google Workspace, Microsoft 365, and other provider acceptable-use policies
- Not use the Service to send phishing, malware, scams, hate, illegal offers, or non-consensual bulk mail
- Not upload or demand that we host your marketing "clicker" or stolen lists as seed assets
- Not attempt to reverse engineer, overload, scrape, or disrupt the Service
- Not resell access without written permission
You are solely responsible for the content of any messages, the quality of any lists you later mail, and the consequences of your sending after warmup.
7. No guarantees of results
We make no warranties or guarantees regarding inbox placement, deliverability, engagement rates, domain or IP reputation, spam folder rates, promotions-tab placement, or business results. Warmup is an assistive process. Outcomes depend on factors outside our control, including prior domain history, content, list quality, volume, complaints, ISP algorithms, and infrastructure. Dashboard scores and estimates are operational indicators only, not promises.

8. Seed engagement and AI
The Service may use a combination of automated seed-style engagement, simulated network behavior, and/or third-party infrastructure to produce positive sending signals. AI may draft short human-like messages and replies. AI text is not legal, compliance, or deliverability advice. You are responsible for reviewing configurations and ensuring your overall sending program remains lawful.
9. Intellectual property
The Service, branding, software, UI, and documentation are owned by FiveToClose / Email Fire Domain or our licensors. Subject to these Terms and a paid subscription where required, we grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes. You retain rights to your domains and content; you grant us a license to process them only as needed to operate the Service.
10. Third-party services
The Service depends on third parties including Google, Stripe, AI providers, hosting providers, and mail carriers. We do not control their availability, policies, or pricing. Your use of third-party services is subject to their terms.
11. Suspension and termination
We may suspend or terminate access immediately if we reasonably believe you violated these Terms, pose a security or abuse risk, fail to pay, or if required by law. You may stop using the Service and cancel your subscription as described above. Provisions that by nature should survive (including disclaimers, liability limits, indemnity, and payment obligations incurred) will survive termination.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR EFFECTIVE FOR ANY PARTICULAR DOMAIN OR CAMPAIGN.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIVE TO CLOSE, EMAIL FIRE DOMAIN, AND THEIR OPERATORS, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, DELIVERABILITY, OR BUSINESS OPPORTUNITY, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM (OR USD $50 IF YOU HAVE NOT PAID US).
14. Indemnity
You agree to indemnify, defend, and hold harmless FiveToClose, Email Fire Domain, and their officers, agents, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Service; your domains, mailboxes, credentials, and messages; your mailing lists and campaigns; your violation of law or third-party rights; or your breach of these Terms.
15. Changes to the Service or Terms
We may modify the Service or these Terms. We will update the "Last updated" date when Terms change. Material changes may be communicated via the site or email when practical. Continued use after changes constitutes acceptance.
16. Governing law
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise. Venue for disputes shall be in courts located in Texas, USA, except where prohibited.
17. Miscellaneous
If any provision is unenforceable, the remainder stays in effect. These Terms, the Privacy Policy, and the Disclaimer are the entire agreement regarding the Service. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
